Internet Crimes
According to the 2007 Internet Crimes Report, the Internet Crime Complaint Center (IC3) received 206,884 complaints of crimes perpetrated over the internet during 2007. More than 90,000 of these were referred to law enforcement officials around the nation, with nearly $240 million in reported losses. This represents an increase in almost $40 million in reported losses from complaints referred to law enforcement in 2006. While this report does show how extensive these types of crimes have become, they do not show how often this type of crime goes unreported.
Internet auction fraud was the most widely reported complaint, but other activities cited include credit/debit card fraud, computer intrusions, spam/unsolicited email and child pornography.
When cases are referred to law enforcement officials, they will investigate the case and possibly make an arrest. If you do a criminal background check on a job candidate, you probably won’t find these records at a county or state level. Internet crimes generally are tried in federal court and records are in the federal district court where the case was tried, rather than at the county or state level.
You should also be aware that these types of crimes are not limited to blue collar workers. Local news coverage seems to always be talking about this government official or that CEO that has been charged with these types of crimes.
You may want to talk to your background screening company about federal district searches and see if they might be a beneficial tool for your company’s background screening.

Background Screening and the Temporary Employee
In an article posted on the SHRM website, they discuss screening temporary employees and share the advice that screening should not be ignored when you bring a temporary employee in to your organization. The article goes on to mention that, with the tightening labor market, temporary and contract employees are making up 10-30 percent of the average work force in US Companies.
Some employers choose not to screen their temporary or contract employees, assuming that the agency that places them are doing the screening. Some agencies do screen those employees. However, if you don’t have guidelines set up with the agency on what you will accept for screening, the agency may only be doing minimal checking – such as criminal checks in the county of residence only.
The article does continue by stating “Ultimately, it’s the responsibility of HR to ensure that those workers don’t inflict damage on the organization and its people, buildings and reputation…These people have the keys to the kingdom. Once they’re inside your building, they have access to your files and have the potential to do great harm.”
A Benchmarking survey that was conducted by a screening company found that fewer than half of companies screen their temporary labor. Industry statistics show that temporary workers are more than 50 percent more likely than full-time workers to have a felony or drug related record.
Basically you have two options. You can screen those contracted and temporary employees through your screening system, or you can communicate with the agencies and have them follow your screening protocol. If you supply them with guidelines on the level of screening you expect to be performed, they will need to comply in order to keep your business. If a staffing vendor tells you they already do background checks, this may not be much of a defense for an employer if the check is considered inadequate or ineffective. For this reason, you need to have adequate due diligence in order to head off any potential problem down the road.

A common question we get is “where did you find that information?”. There is a large misconception “out there” about secret databases and information stockpiles. In part, this is caused by the internet. In the last 10 years or so, any time we had a question we could go to the internet for the answer. “Just Google it” is a common phrase heard ‘round the world.
However, when background screening is added to this equation, you have to be very careful “just Googleing it”. If you do an internet search for criminal records the records you find may not be accurate. You may be getting records of arrest where a case has been dismissed or someone was found not guilty. You may even find inaccurate information or information that isn’t really related to whomever you are searching for.
A reputable background screening company is going to get the information for you the old fashioned way. They are going to call the employers, they are going to call the schools and they will send court runners in to the courts. The information that they provide to you will be in a report that you can view, print, or keep in a file. That report is also going to be FCRA compliant and can be used as a tool when you make a hiring decision

You would get a full listing of all employment information, student records, credit history, and probably what they had for breakfast last week. The truth is that there is no such database or stockpile of personal records.

For that reason it is very important to obtain the person’s full name and date of birth, as well as any maiden or alternate names that they may have used. A reputable background screening company will be able to complete a background check for you for a job candidate that lived, worked, and was educated in a foreign company. One thing to keep in mind however, are the cultural and societal diversities within that country. If you were to call your background screening company and ask them to verify a high school diploma for someone from 1970 in North Korea, chances of getting a verification are slim to none. Also, in Hispanic societies you will be asked to provide a mother’s maiden name. The Hispanic culture is a matriarchal society which means that everything involving school records is going to be verified using a mother’s maiden name.

What Criminal Searches should I run? - County Searches
There used to be a time when you could do a criminal background check on someone in the county that they lived in and that was considered very modern and thorough. However, that may not be the case today. So, what criminal searches should you run to be as thorough as possible when doing background checks? There are several different types out there.
A county criminal search where you candidate lived over the last 7 years is a good start. A county search will have a court researcher going in to that county courthouse and providing a candidate’s name and date of birth to check for records. You as a hiring manager must be made aware that felony searches are reported at a county level, but misdemeanor crimes are not always held at a county level. Each jurisdiction that has a police department has the authority to charge someone with a crime. If that crime is considered a misdemeanor, it may never be recorded at the county court house. What Criminal Searches should I run? - County Searches
There used to be a time when you could do a criminal background check on someone in the county that they lived in and that was considered very modern and thorough. However, that may not be the case today. So, what criminal searches should you run to be as thorough as possible when doing background checks? There are several different types out there.
A county criminal search where you candidate lived over the last 7 years is a good start. A county search will have a court researcher going in to that county courthouse and providing a candidate’s name and date of birth to check for records. You as a hiring manager must be made aware that felony searches are reported at a county level, but misdemeanor crimes are not always held at a county level. Each jurisdiction that has a police department has the authority to charge someone with a crime. If that crime is considered a misdemeanor, it may never be recorded at the county court house. You have hired “John” to work with your company. John has been there a couple of months and is doing a good job and seems to be fitting in well with his coworkers. Soon, rumors start to filter up to your location that John may have some legal troubles going on. Someone tells you that he was arrested this last weekend but doesn’t have any details for you. You do background checks on your employees with a screening firm and decide to call them to see what they can do.
There are a couple of things you need to be aware of before you start another criminal background check. The primary thing to be aware of is your release authorization. Do you use one? If you do, does it indicate on the release that you may conduct additional searches for that person during the course of their employment? If it does not, you may have to get John to sign another release, which could be very awkward for you. If your release does cover continuous background checks, the next thing you want to ask yourself is when did this reported arrest occur? If it was this last weekend, and today is Tuesday, chances are that the courts are not going to have any records of it yet. Keep in mind that a criminal records search is conducted through a court. If John has only been arrested and has not been to court yet, the court isnt going to have any idea what is going on. Where did they get it? How is it reported? Was it followed up on? Is there a name and phone number of a real person on the website that you can call and ask these questions of?
An employment screening agency that is FCRA compliant will be happy to explain how they work, what they do, and where the information comes from. They will also ask you to sign up with an agreement for service with their company. Generally, the purpose of the agreement is to allow that screening firm to do background checks for your company, and will take the time to talk with you about your needs and what you are looking for with your employment screening.

What is Adverse Action in Pre-employment Screening?
What is Adverse Action?
Section 603(k)(1) of the Fair Credit Reporting Act (FCRA) states that an adverse action is “a denial of employment or any other decision for employment purposes that adversely affects any current or prospective employee.” These decisions include not hiring, not retaining or not promoting an individual.
What does this mean for my company?
If your company uses a consumer report/investigative consumer report in whole or in part to deny someone employment or promotion, you are obligated under the FCRA to provide both Pre-Adverse and Adverse Action Disclosures to those applicants/employees.
What is a Pre-Adverse Action Disclosure?
The disclosure must contain information stating that an adverse employment action will be taken, a copy of the consumer report/investigative report, and a summary of the applicant’s/employee’s rights. The disclosure must also include the consumer reporting agency’s name and contact information. Once the applicant/employee receives the disclosure, he or she must be given sufficient time to dispute the information.
What is an Adverse Action Disclosure?
The Adverse Action Disclosure contains wording similar in nature to the Pre-Adverse Action Disclosure and must be done in a reasonable amount of time after the Pre-Adverse Action Disclosure. The disclosure informs the applicant/employee of the final decision made by your company in not hiring, not retaining or not promoting an individual.
Do I need to do both the Pre-Adverse Action and the Adverse Action Disclosures?

Juvenile Criminal Records
If an adult goes through the criminal court systems, except in rare circumstances the records are a matter of public information. This is not the same if the offender is a juvenile, which is generally someone under the age of 18. This is not meant to address the issue of a juvenile under the age of 18 who is tried as an adult. That is a blog for another time!
Generally, in the juvenile court system, the juvenile being charged is charged with one of two crimes. Generally they are charged with delinquency or engaging in delinquent behavior, or truancy. The criminal process is also different in that a juvenile does not have the right to a trial by jury. A court judge is charged with hearing the case and sentencing a juvenile offender. The court judge will issue the sentence with the aim of rehabilitating the juvenile. Except under extreme circumstances, those records are closed and confidential. Upon the juvenile turning 18, the records would be expunged or destroyed at the courts discretion.
For employment screening, some juvenile records may be available but only under specific guidelines based on the type of position the person is applying for. However, gaining access to these records is a very difficult process.

Juvenile Criminal Records
If an adult goes through the criminal court systems, except in rare circumstances the records are a matter of public information. This is not the same if the offender is a juvenile, which is generally someone under the age of 18. This is not meant to address the issue of a juvenile under the age of 18 who is tried as an adult. That is a blog for another time!
Generally, in the juvenile court system, the juvenile being charged is charged with one of two crimes. Generally they are charged with delinquency or engaging in delinquent behavior, or truancy. The criminal process is also different in that a juvenile does not have the right to a trial by jury. A court judge is charged with hearing the case and sentencing a juvenile offender. The court judge will issue the sentence with the aim of rehabilitating the juvenile. Except under extreme circumstances, those records are closed and confidential. Upon the juvenile turning 18, the records would be expunged or destroyed at the courts discretion.
For employment screening, some juvenile records may be available but only under specific guidelines based on the type of position the person is applying for. However, gaining access to these records is a very difficult process.

What's In A Name?
Have you ever tried to screen someone and called in to an employer or a school and provided them a name, only to be told that they have never heard of the person? Generally, when that happens we find that it is because we don’t have the correct name.
Criminal records are filed in our court system by name and date of birth. If the candidate that is being screened had more than one name, you would need to search under all names as records generally will only be found in that court if all names are searched. This works for both first and last names. If you are considering a background check for someone by the first name of Richard, you need to see if they go by the name of Rick, Dick, Richey, or Rich. Court records are going to be searched by Richard and you may not find records if the applicant’s docket information is under an alternate first name.
This is a frequent problem with schools as well, particularly high schools. If you are trying to verify that a female applicant is a high school graduate, the name that she graduated under is imperative – otherwise you will get a no record found.

I-9 Compliance and What It Means
I once had an employer call in and ask about the services offered. When I mentioned the I-9 Compliance, his response was “I know the majority of my work force isn’t legal, why do I need to prove it”. While the answer was unexpected, it wasn’t unusual. Many employers either knowingly hire illegal aliens, or go with the policy of “don’t ask, don’t tell”. However, with the government reforms that are going on, that is going to be a choice that an employer no longer has.
The Form I-9 is a form all employers are required to use to verify employment eligibility of all employees they hire – both US workers as well as aliens. It is required by the INS (Immigration and Naturalization Services) to verify the identity and eligibility to work for all employees. At the time the form is completed, the employee must also provide valid, original identification. There are different forms of identity that the employee can provide.
There are a lot of different ways to do I-9 compliance, either through the Department of Homeland Security or through a background screening agency that may give you a little more guidance in getting through the system. The point is that there is no longer a choice on whether you comply with the I-9 verification. If you don’t there are going to be some very hefty fines and penalties coming your way. Effective 03/27/2008, the Federal government raised the fines approximately 25% on violations. Those penalties can include fines from $375 to $3,200 for each unauthorized alien on a first time violation, to up to $16,000 penalty for each unauthorized alien with multiple violations. These penalties are assessed on a per-alien basis. Therefore, if an employer knowingly employed, or continued to employ, five unauthorized aliens, that could result in five fines.
